MLS Rule Changes Effective Immediately

Recap of recent MLS Rule changes as approved by the Board of Directors in their May and June Board meetings. These revised rules are effective immediately (as of this notice).

Attached to this document is a copy of the rule changes identifying deleted language by striking through the deleted words and underlined words is new language added to the rules.

Overview of Changes:

For a quick recap the following is provided: 

  • Listing Exclusion Paperwork – Must be filed with the MLS within 1 business day of obtaining the listing.
  • Narrative: No external third-party links and or websites are allowed in the narrative.
  • Data Manipulation: Withdrawing, cancelling or early expiring of a listing and then re-entering it into the MLS under a new MLS listing number without a new listing agreement is defined as Data Manipulation.   A violation of this rule results in an administrative fine of $250 and requirement to attend a 2-hour class on the MLS Rules. Failure to attend the class within the prescribed time results in an additional administrative fine of $1,000. A second violation of the Data Manipulation rule results in both the Broker and Agent being fined $500.Any additional violations of this rule result in both the Broker and Agent being fined $1,000 per violation.
  • Fines for non-compliance: If you are issued an MLS fine you and you believe it was NOT a violation of the rules, you have 10-days to appeal the fine with the MLS Committee. There are 2 types of fines in the MLS Rules, and they have been defined in the rules.
    1. Administrative Fines: A violation may be reported or discovered by Staff and there is a pre-established fine stated in the rules, the fine is issued to the member. You have an opportunity to appeal this fine with the MLS Committee to explain why the reported circumstance of the violation is not accurate or would not constitute a violation of the MLS Rules.
    2. MLS Committee Issued Fines: This type of fine would be issued for a violation of the MLS Rules that the fine is not specifically stated for that type of violation in the MLS Rules. For this type of violation, the MLS Committee would request a hearing with the member and make their ruling based on the information from that hearing. This type of fine could be appealed to the Board of Directors.
  • Contact information in the listing: Placement of visible contact information to the public anywhere in the listing including but not limited to the narrative section, photo, audio, videos, or virtual tours, etc. is prohibited.
  • Fines for Coming Soon violations: Fines for this violation has been reduced to $250 with a requirement to attend a class on the MLS Rules and Regulations. Failure to complete the class within the prescribed time results in an additional fine of $1,000. A second violation will result in a $500 fine to both the Agent and Broker. Subsequent Coming Soon Rule violations by the same Agent results in an administrative fine of $1,000 per day (not to exceed $15,000) until the violation is corrected. Failure to correct the violation within 3 business days additionally results in suspension of the MLS access.
  • Fines for Clear Cooperation: Fines for this violation has been reduced to $250 with a requirement to attend a class on the MLS Rules and Regulations. Failure to complete the class within the prescribed time results in an additional fine of $1,000. A second violation will result in a $500 fine to both the Agent and Broker. Subsequent Clear Cooperation Rule violations by the same Agent results in an administrative fine of $1,000 per day (not to exceed $15,000) until the violation is corrected. Failure to correct the violation within 3 business days additionally results in suspension of the MLS access information.
