Am I in violation of the Code of Ethics if I don't follow the detailed showing instructions in the MLS?

Yes, As a reminder, when showing instructions have detailed requests such as all parties wearing masks or disclosures that need to be signed and returned before showing it is your responsibility to follow those instructions or you could be found in violation of the Code of Ethics.

 

Buyer’s Agent/Broker

It is a violation of the Code of Ethics Article 3 and the complaint could also qualify as a citable offense of Article 3: Standard of Practice 3-9 with a $500 fine and required Code of Ethics training within six (6) months if you do not abide by stipulated showing instructions.

 

Standard of Practice (SOP) 3-9 reads: Providing access to the listed property on terms other than those established by the owner or the listing broker.

 

Listing Agent/Broker

It is a violation of the Code of Ethics Article 1 and the complaint could also qualify as a citable offense of Article 1: Standard of Practice 1-16 with a $500 fine and required Code of Ethics training within six (6) months if you do not abide by the terms authorized by the owner or seller.

 

Standard of Practice (SOP) 1-16 reads: Accessing or using, or allowing others to access or use, a property managed or listed on terms other than those authorized by the owner or seller.

 

We are still in a time of concern with COVID-19. If you are showing properties and conducting open houses, as a professional, you should be taking the highest precautions possible to ensure everyone's safety.
